Terms of Service

1. Acceptance

By creating an account or otherwise using phoerbox, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the service.

These Terms are written in plain English on purpose. We avoid legal jargon when it would obscure rather than clarify the rules. If something here is ambiguous, write to us and we will clarify it; if ambiguity persists, the reading most favorable to the user prevails.

2. What phoerbox is

phoerbox is a server-side tracking and conversion attribution platform. It receives webhook events from your e-commerce or checkout provider, processes them, and forwards them to advertising platforms you connect (such as Meta Conversions API, Google Ads, and others as we add support).

phoerbox is currently in early-access stage. Features may change, break, or be removed without long advance notice. We try to minimize disruption and will give reasonable notice for changes that affect production behavior.

You retain all rights in the data you send through phoerbox (webhook events, container configurations, etc.). You grant us a limited, non-exclusive license to process that data solely to provide the service to you (receive, store, transform, forward to the destinations you configure).

We do not analyze your data for our own commercial purposes. We do not sell your data. We do not use it to train models. The detailed treatment of personal data is in our Privacy Policy.

phoerbox integrates with third-party services that you choose to connect (Meta, Google Ads in the future, your checkout providers, etc.). When you connect them:

We aim for high availability but do not offer a formal SLA or uptime guarantee in this early-access phase. The service is provided "as is" and "as available". We may schedule maintenance windows or experience unscheduled downtime. We do not commit to compensation for downtime in this stage; if and when a paid commercial tier is introduced, an SLA may be added to it.

9. Pricing

phoerbox is currently free during early access. Pricing terms for any future paid plan will be presented before you opt into a paid plan, and the version of these Terms in force at that time will reflect them.

10. Suspension and termination

10.1 By you

You can stop using the service and request account deletion at any time by emailing phoerboxemergency@gmail.com. We delete your account and associated data within 30 days, subject to retention obligations described in the Privacy Policy.

10.2 By us

We may suspend or terminate your access if you violate these Terms, if your use creates legal risk for us, or if we are required to do so by law or by a third-party platform we depend on (e.g., Meta). Whenever possible we give notice and a reasonable cure period before terminating.

11. Disclaimers

phoerbox is provided "as is" without warranties of any kind, express or implied, including (but not limited to) merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, or availability.

We do not warrant that the service will be uninterrupted, error-free, or that data will be successfully delivered to every destination in every condition. Conversion forwarding depends on third-party APIs outside our control.

12. Limitation of liability

To the maximum extent permitted by applicable law, in no event will phoerbox (or its operators) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost revenue, lost data, loss of business opportunity, loss of goodwill, or attribution errors — arising from or related to your use of the service, even if advised of the possibility of such damages.

Where liability cannot be excluded under applicable law (notably the Brazilian Consumer Defense Code where relevant), our aggregate liability shall not exceed the greater of (i) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (ii) BRL 100.

13. Indemnification

You agree to defend, indemnify, and hold harmless phoerbox and its operators against claims arising from (a) your breach of these Terms, (b) your violation of any third-party rights or applicable law, or (c) the data you sent through phoerbox.

14. Changes to these Terms

We may update these Terms as the product and our legal obligations evolve. Material changes will be notified by email to account holders at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. Disputes shall be brought before the courts of São Paulo, Brazil, except where mandatory consumer-protection rules dictate otherwise.

16. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and phoerbox regarding the service and supersede any prior communications.
